If you and your ex-partner owned a property together or if one of you owned a property in which the other lived, then you might be able to make a claim under the Trusts of Land and Appointments Act (‘TOLATA’) to determine:

·       How the property is owned.

·       If the property should be sold.

·       If anyone can remain in the property.  

These claims arise between unmarried couples following a separation and the Court can make orders in any of these respects.
